The litigation funding market exists to support clients who either lack the funds to pursue a legal case or who have the funds but would like to share some of the risk with a third party. 

Two specialist products underpin this market:

i)                   After the Event insurance ('ATE insurance')

ii)                  Third party litigation funding.

ATE insurance is an insurance product that acts as a safety net for clients against an adverse outcome by providing an indemnity for legal costs (both own and/or adverse costs) in the event that a client loses an arbitration or a piece of litigation.

Third party litigation finance is where a third party company provides a non-recourse finance solution for a claimant to finance their legal bills. In exchange for providing litigation finance, the funder is entitled to a share of the claim proceeds if the case is ultimately successful.
